from May, 2006 through July,
2007 in Bath County, Ken-
tucky the above named defen-
dant committed the offence
of Food Stamp Benefit Fraud
when she with the intent to
defraud the Food Stamp pro-
gram, made false statement
and failed to disclose material
factors affecting her eligibility
and did receive $5,931.00 in
benefits to which she was not
entitled. Bail $5,000

charges that in Bath County,
Kentucky the above named
defendant, 1. That on or about
the 8th day of December,
2008, committed the offence
of Theft By Unlawful Tak-
ing Over $300 when he took
a 2007 Kymco ATV valued
at $2,000, belonging to Lisa
R. Bocook. 2. Committed the
offence of being a Persistent
Felony Offender, First-De-
gree, when being more than
21 years of age, he: (A) That
prior to December 8, 2008,
the defendant was convicted
of theft by unlawful Taking,
over $300, by final Judgment
of the Menifee Circuit Court
under Indictment 06-CR-
00018 and was sentenced to
one (1) year on March 8, 2007;
and, 03) that prior to commit-
ting the offence(s) for which
he was convicted of Criminal
Mischief 1st, by final Judg-
ment of the Rowan Circuit
Court under Indictment No.
04-CR-00054, on August 6,
2004; and, (C) At the time of
the offences identified under
(A) and 03) of this court, the
defendant was over eighteen
years of age as his birth date
is February 25, 1983; and, (D)
that pursuant to the convic-
tions under (A) and 03) of this
court, he was sentenced to a
term of imprisonment of one
year or more; and, (E) that he
was on parole from at least
one such prior conviction at
the time he committed the of-

unlawfully failed to provide
child support for minor chil-
dren for which he was under
a court order to do so. Said ar-

offence of being a Persistent
Felony Offender, Second-De-
gree, when now being more
than 21 years of age, date of
birth January 18, 1981, and
at the time of the prior offence
was over the age of eighteen

February 8, 2002, he entered
a plea of guilty to Indictment
No. 01-CR-00036 in the Flem-
ing Circuit Court charging
him with Trafficking in Mari-
juana, Five Pounds or More
and was on March 8, 2002,
sentenced to a period of Five
(5) Years, and, 03) The Grand
Jury further charges that the
sentence received under (A)
of this indictment was within
five years of the commission of
the offence charged in Count
One of the herein Indictment.
