of Sale entered in Bath Circuit

13 December 2003, at the hour of

A certain tract of land with resi-
dence lying and being in Bath
County, Kentucky, just East of
City limits of Owingsville and on
North side of U. S. Highway No.
60, on Rosebud Lane, and de-
scribed more particularly as fol-
lows, to wit:

post comer to same, Helen Miller
and John H. Link; thence

boundary line of John H. Link
property a distance of 85 feet 3
inches, more or less, to a point a

It is understood and agreed be-
• tween the parties that there is a
well lying on the West side of the
house on the above-described
property and from said well John
tL Link, his heirs and assigns,
have permanent right and privi-
lege and access to water from said
well and the right to draw and take
water from said well and this con-
veyance is made specifically sub-
ject to such rights in said John H.
Link, heirs and assigns.
There is also conveyed to the
grantees, their heirs and assigns,
but without warranty, any and all
i interest whatsoever which the
grantors, Roy H. Vice and Ethel
Vice, his wife, now have or own in
said land over which said 12 foot
passway leads northwardly to the
John H. Link property and further
there is conveyed such interest as
the grantors may have in and to the
passway road leading westwardly
to the Helen Miller property, it
being the intention of the grantors
hereby to transfer and convey to
the grantees herein any and all
rights or interest which the
grantors have in and to either of
said passway or said road or the
land which said passway or said
road now lead.

A certain tract of land with resi-
deuce lying and being in Bath
County, Kentucky, just East of
City limits of Owingsville and on
North side of U. S. Highway No.
60, on Rosebud Lane, and
described more particularly as fol-
lows, to wit:

stake of East side of driveway or
road corner to same and property
of Virgil Gillon: thence Westward-
', ly with other property of Roy H.

more or less, to a point a set stake
to same, Roy H. Vice, now
Wilmer Adams and wife and
Helen Miller; thence Northwest-
wardly distance 48 feet 8 inches,
more or less, with line of Mrs.
Helen Miller, comer to same and
property of James Blevins; thence

There is a common well on said
property which is used for the ben-
efit of the above-described proper-
ty and other property of Adams,
now Price. Now, the grantees,
their heirs and assigns, shall have
the perpetual right to use water
from said well on an equal basis
with Roy H. Vice, his heirs and
assigns.
The grantees, their heirs and
assigns, shall have and are hereby
conveyed perpetual use of pass-
way road on the South and East
side of the above-described prop-
erty as said road now exists and is
now used.
BEING THE SAME PROPER-
TY conveyed to David Earlywine
and wife, Darlene Earlywine (aka
Mildred D. Earlywine) from Greg
Helton and Sarah Helton, by Deed
dated 14 December 1999 of record
in Deed Book 192, Page 439, Bath
County records.
This property is sold subject to all
real estate taxes, easements, and
off-sales of record; and reference
is hereby made to the office of the
Bath County Clerk.
The terms of the sale shall be ten
(10%) per cent cash or check at the
time of sale and the balance on
credit of thirty (30) days with priv-
ilege of the successful bidder to
pay in full at the time of sale. The
successful bidder requesting cred-
it must execute bond with
approved surety bearing interest at
the rate of twelve (12%) per
annum from date of sale until paid,
which bond shall have the full
force and effect of a Judgment and
should execution be issued there-
on, no replevy shall be allowed. A
lien shall exist and shall be
retained by the Commissioner on
the property sold as security for
the purchase price.

line booster pumping stations, ren-
ovation of existing booster pump-

Contractor shall furnish all materi-
als, equipment and labor neces-
sary to complete the construction
of the waterline and pump sta-
tions, including trenching, excava-
tion, bedding, installation of the
waterline, all tie-ins, appurte-
nances, backfill and any other
action required for a complete
watediqe installation. Time of
completion will be 180 Calendar

Contract 17--Will consist of the
fabrication and construction of a
1,000,000 gallon, welded steel,
ground storage tank, access road,
geotechnical report, site work and
appurtenances. Excavation is
unclassified. The Contractor shall
furnish all materials, equipment
and labor necessary to complete
the construction of the tank,
including site grading, access
road, site work, site tiping, appur-
tenances and any other action
required for .a complete tank
installation. Tune of completion

glass lined talak, ground storage
